TERMS AND CONDITIONS

1. This promotion is open to all persons aged 18 or over. All participants must be of legal drinking age in their country of origin and at least 18 years of age, which ever is the highest, excluding the employees of LexisPR, the Promoter or their immediate families, associated agents, or anyone associated with the administration of this promotion.  
2. Subject to availability, one entry to the 1 pence-auction and an entry number will be issued on arrival at the sale event on 27th March 2009
3. One entry number per person throughout the promotional activity 26th February 2009 to 26th March 2009.  
4. To enter the auction and be in with a chance of buying the original Banksy print for 1 pence, participants should register online at www.artichokeltd.com/brahmabanksy and fill in their details including their name, date of birth and contact details. Participants should then be able to attend the draw and 1 pence-auction at a secret location on 27th March and agree to participate in PR activity before, during and after the auction’s completion. Only participants who agree to all terms and conditions, to attend the draw and 1 pence-auction and  to participate in PR activity will be entered into the prize draw.
5. Entry number is valid only for the draw on 27th March 2009.
6. By entering this competition, the participant will be deemed to have read and understood these Terms and Conditions and be bound by them and the requirements in any other promotional material.
7. The promotional period commences on 26/02/09 and closes on 26/03/09.
8. All registered entries will be entered in the  draw. No responsibility will be accepted for lost, late or mislaid entries, or any entry card that is damaged defaced, illegible, incomplete or does not comply with these Terms and Conditions in any way.
9. One participant who entered into the 1 Pence-auction  draw will be drawn at random to win the opportunity to buy the 1 Pence print. (“Winning Participant”)
10. The Winning Participant will be able to buy an original Banksy print for 1 Pence.
11. The print must be accepted as offered and is not transferable. No cash alternative will be offered in whole or part.
12. All conditions warranties and representations expressed or implied by law or otherwise in relation to the prizes and this promotion are excluded to the fullest extent permitted by law and the Promoter shall be under no liability whatsoever or howsoever in connection with any loss, damage or injury which is suffered as a direct or indirect result of any of the prizes and the promotion except the Promoter makes no attempt to exclude or limit its liability for death or personal injury arising as a result of the negligence of the Promoter
13. The closing date for this promotion is 00:01 hours 26/03/09 by which all registrations must be received.
14. The draw and 1 pence-auction will take place at a secret London location to be confirmed by email 48 hours prior to it taking place on 27/03/09. The draw will be made by a person who is independent of the Promoter. The decision of the independent person making the draw as to the result will be final .
15. The Winning Participant will be informed  at the  draw and can then bid 1 pence for the original Banksy print. .
16. The original Banksy print can be collected from Lexis Public Relation, 8 Bolsover Street, W1W 6AB, by the Winning Participant, subject to identification, once the Winning Participant has been notified
17. The Promoter  will not be held responsible for the failure to fulfill obligations of any third parties involved in this promotion and prize draw, although they will endeavour to minimize the effect to the entrant of such failure.
18. The Promoter will not be held liable to any participants   for any fraud committed by any third party nor in an event beyond its control.
19. Participants agree that their personal information will be used for the purposes of administering the promotion and prize draw and in connection with any advertising mentioned in these terms and conditions. Please note that in processing the information in this way the Promoter may disclose the information to other companies in its group or to third parties employed by the Promoter. Participants should  not enter the draw          for the 1 Pence-auction  if they do not want the Promoter to hold personal data for this purpose.
20. The Winning Participant hereby consents to participate in any reasonable publicity accompanying and resulting from the promotion required on behalf of the Promoter if so requested.
21. The name and county of the prize winner will be available by contacting Nic Rider at Lexis PR after 30/3/09 .
22. If there is any reason to believe that there has been a breach of the Terms and Conditions or incorrect, illegible, fraudulent or other invalid or improper information has been provided, the Promoter may at its sole discretion refuse to process an entry or fulfill any prize award.
23. The Promoter reserves the right to amend, alter or withdraw the promotion as necessary due to exceptional circumstances outside their reasonable control and to substitute the prize or vouchers with ones of equivalent or greater value.
24. The Promoters decision will be final in all circumstances and no correspondence will be entered into.
25. These Terms and Conditions are subject to the Laws of England and Wales and to the exclusive jurisdiction of the English courts.
